1. Introduction

Welcome to Hype! People hype you up more than you think—you just don't always get to see it. Now, you do. Hype lets you uncover the love, curiosity, and lowkey admiration that's already out there, turning quiet appreciation into something you can actually see. It's all about making your day better with unexpected hype. These Terms & Conditions (the "Terms") make sure everything runs smoothly. 2. Acceptance of Terms

By accessing or using Hype, you agree to these Terms & Conditions. If you don't agree, Hype may not be the platform for you.

3. Eligibility

To join the Hype community, you need to be a real person - no bots or AI here! You must be at least 13 years old. However, if the minimum age for using social media in your country is higher than 13, you must comply with the local age requirement. If you're under the age of consent in your country, you'll need a parent or guardian to give their consent for you to use Hype. If you're creating an account for someone else, like a company or organization, you need to have the authority to do so. When we say "you," we mean both you, the end user, and, if applicable, the entity you represent.

4. Account Registration and Security

To use Hype, you'll need to create an account with your name, phone number, and, if needed, your email address. Keep your account information secure, because you're responsible for everything that happens under your account.

5. User Conduct

You agree to use Hype in a lawful manner and adhere to our content guidelines. Prohibited behaviors include, but are not limited to:

• Harassment or posting offensive content.
• Violating any applicable laws or regulations.
• Posting offensive, obscene, or inappropriate content.
• Hate speech, discrimination, or content that promotes violence or illegal activities.
• Nudity or explicit material that exploits others (Hype has a zero-tolerance policy toward this type of content).
• Spam, phishing, or any fraudulent activities.
• Sharing personal information of other users without their explicit consent.
• Posting content that infringes on the intellectual property rights of others.
• Unauthorized access or use of Hype's systems, data, or services.
• Interfering with or disrupting the functionality of Hype, including servers and networks.
• Posting false or misleading information.
• Impersonation of others or misrepresentation of affiliation with any person or entity.
• Creating multiple accounts to evade restrictions or for deceptive purposes.
• Engaging in or promoting illegal activities through the platform.

Content that violates these guidelines may be removed, and repeat offenders may have their accounts terminated.

6. Content Ownership and Rights

Content includes profile photos, photos, videos, emojis, captions, comments, or messages shared through our Services.

You own the content you create and share on Hype—what's yours stays yours. However, in some cases, we may ask for your permission to share or redistribute certain content (for example, for promotional purposes or new features). If you agree, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content as needed to enhance the Hype experience. This license allows us to operate and improve Hype, but it does not transfer ownership of your content to us.

By using Hype, you understand that content shared with your school is visible to other users at your school and may be reshared or interacted with within that community. If you choose to delete your content, it will no longer be visible in the app, but some copies may remain in backups or where required by law.

7. Privacy and Data Protection

Hype collects the following personal data to operate and improve the app:

• Name (first and last): Used for identification and personalization.
• Phone number: Required for authentication and account security.
• Date of birth: Used to verify age eligibility and may be visible to other users.
• Profile picture: Used for user identification and visibility within the app.
• Location data: Collected only when interacting with specific features that require geofencing or limiting Hype to specific regions. We do not track or collect location in the background!
• Usage data: Includes interactions with the app, such as polls answered, engagement with features, and general activity.
• Performance data: Helps us understand how the app functions by measuring load times, feature performance, and overall system efficiency.

Use of Data

We use this data for account creation, authentication, verification, and to enhance your user experience through personalized content and analytics. Location data is used solely for geofencing purposes.

Data Sharing

Hype does not currently share user data with third parties for financial gain. However, Hype reserves the right to share user data with third parties, including content moderation platforms, to ensure compliance with content guidelines and enhance the platform's functionality.

Data Protection Measures

Hype employs strict data privacy measures to protect your information. We utilize industry-leading data privacy protocols to prevent data breaches and ensure user data security.

8. Data Export

As a Hype user, you have the right to access and export your personal data. This includes the right to receive the personal data you have provided to us in a structured, commonly used, and machine-readable format. You also have the right to transmit this data to another service provider of your choice.

How to Request Data Export

To request a copy of your personal data or to transfer your data to another service, please contact us at support@downloadhype.app. We will process your request in accordance with applicable data protection laws and provide you with your data within a reasonable timeframe.

By using Hype, you acknowledge and accept these rights regarding data export and understand how to exercise them.

9. Compliments and Engagement

When creating and participating in compliments, you agree to follow our content guidelines. Inappropriate and disrespectful content may be reviewed and removed. Positivity is not an afterthought, but an intentionlly crafted experience. Additionally, please consider the following guidelines to ensure a positive and engaging experience for all users:

• Honest Participation: Engage in compliments and comments with honesty and integrity. Misleading or deceptive participation undermines the purpose of the platform.
• Respect for Others: Be respectful in your interactions and responses. Disparaging comments or responses that violate our content guidelines will not be tolerated.
• Privacy: Do not request or share personal information through comments and responses. Respect the privacy of other users at all times.
• Reporting: If you encounter any content that violates these guidelines or our content policies, please report it to us for review.

In order to make the best product we can, Hype collects analytics data to inform our product decisions. We collect a variety of analytics including usage data, performance data, location data for geofencing analytics (if we turn on geofencing), and other miscellaneous metrics like which permissions are enabled for Hype. Permissions such as photo gallery and notifications are also tracked and stored to ensure optimal functionality.

11. Third-Party Services

Hype integrates with various third-party platforms and reserves the right to integrate with additional services in the future. These integrations help improve the platform's functionality. User data and content information may be shared with these third-party services to enhance user experience.

12. Termination of Account

Accounts may be terminated for repeated offenses against our content guidelines. Users will be notified of prohibited content and may appeal terminations via email and a provided form.

13. Limitation of Liability

While we employ advanced data privacy measures and content moderation tools, Hype cannot guarantee the absence of potential risks such as data breaches or exposure to inappropriate content. By using Hype, you agree to the following limitations of liability:

• Inherent Risks: You acknowledge that using an online platform involves inherent risks, including but not limited to data breaches, unauthorized access, or exposure to harmful content.
• Service Interruptions: Hype may occasionally experience technical difficulties, service interruptions, or maintenance periods. We are not liable for any inconvenience or loss resulting from such interruptions.
• User-Generated Content: Hype is not responsible for the content posted by users. You may be exposed to content that is inaccurate, offensive, or inappropriate, and you agree to use the platform at your own risk.
• Data Loss: Hype strives to protect user data, but we cannot guarantee against data loss or corruption. You are responsible for maintaining backup copies of your data.
• Third-Party Services: Hype integrates with third-party services, and we are not responsible for the actions or policies of these third parties. Your interactions with third-party services are governed by their respective terms and conditions.
• No Warranties: Hype is provided "as is" without warranties of any kind, either express or implied. We do not guarantee the accuracy, reliability, or availability of the platform.
• Limited Liability: To the maximum extent permitted by law, Hype's liability to you for any claims arising out of your use of the platform is limited to the amount you paid us, if any, for access to and use of the platform.
• Indemnification: You agree to indemnify and hold harmless Hype, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the platform, your violation of these terms, or your infringement of any third-party rights.

By using Hype, you acknowledge and accept these limitations of liability, and you agree that these limitations are reasonable and appropriate for an online platform.

14. Changes to Terms

Hype reserves the right to modify these Terms & Conditions at any time. Users will be notified of any significant changes, and continued use of Hype constitutes acceptance of the revised terms.

15. License to Use Services

During the time you are using our Services, Hype grants you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use the software provided as part of our Services. This license is solely for the purpose of enabling you to use and enjoy Hype in a manner consistent with these Terms. This license ends when you stop using our Services.

16. Dispute Resolution

We hope to resolve any issues you have with Hype quickly and efficiently. However, if a dispute does arise, here's how we'll handle it:

Arbitration

Any disputes arising out of or relating to these Terms, the use of Hype, or the relationship between you and Hype will be resolved through binding arbitration. This means that an arbitrator, rather than a judge or jury, will decide the dispute. Arbitration will be conducted under the rules of the American Arbitration Association (AAA) and will take place in a mutually agreed-upon location.

Jurisdiction and Governing Law

These Terms and any disputes or claims arising out of or in connection with them will be governed by and construed in accordance with the laws of the state or country in which Hype operates, without regard to its conflict of law principles. You agree to the exclusive jurisdiction of the courts located in that state or country for the resolution of any disputes that are not subject to arbitration.

Class Action Waiver

To the extent permitted by applicable law, you agree to resolve any disputes with Hype on an individual basis and not as part of a class, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

Exceptions

Notwithstanding the above, you and Hype both retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

By using Hype, you agree to these dispute resolution terms, and you acknowledge that you understand and accept them.
